Participant Code of Conduct
For the purpose of this policy, the term “student” refers to any person, regardless of age, who is registered or enrolled in a program, class, or activity offered or sponsored, either entirely or in part by the Community Creative Center (“CCC”). The term “studio member” refers to any person, whether registered in a class or not, who uses the Community Creative Center facilities at Nadine Baum Studios or the Wheel Mobile. The term “participant” collectively refers to anyone defined as a student or a studio member. The term “CCC Staff” refers to the Executive Director, any paid employees, volunteers, or interns working on behalf of the Community Creative Center. The term “CCC Community” refers to students, studio members, and CCC staff collectively. The term “CCC Premises” refers to the CCC Facility at Nadine Baum Studios and the Wheel Mobile, and includes any property owned by, stored in, or leased by the CCC.
It is the intention of the Participant Code of Conduct to clarify certain standards of behavior by Studio Members, Students (and by adults acting on student’s behalf), which are essential to the CCC’s educational mission and its community life. Unacceptable behaviors include, but are not limited to, those described in this Code. Studio Members and Students (and adults acting on their behalf), are expected to comply with all state and federal laws, all stated CCC policies, and to respect the rights and privileges of all other members of the CCC community and its neighbors.
III. DISMISSAL AND REMOVAL RIGHT
At its sole discretion, the CCC reserves the right to dismiss or refuse enrollment to any student (or anyone acting on behalf of the student) whose conduct fails to comply with the policies, rules and standards of the CCC. The CCC reserves the right to terminate the studio privileges of any Studio Member (or an adult acting on behalf of the studio member) whose conduct fails to comply with the policies, rules and standards of the CCC.
IV. PROHIBITED CONDUCT
A. Prohibited conduct includes but is not limited to the following:
Intentionally or recklessly causing physical or psychological harm to any CCC community member, oneself, or to any person in the CCC facility, on the Nadine Baum Studios premises, the Wheel Mobile, or at any CCC affiliated activities regardless of location, or for intentionally or recklessly causing the reasonable apprehension of such harm. This includes, but is not limited to:
- harm communicated via computer, telephone, any other electronic medium, including social media;
- harm in the form of abuse or harassment based on social, racial, religious, cultural, sexual identity, gender, gender identity, sexual harassment, mental or physical impairment;
- verbal, gestural, or written threats;
- verbal abuse or harassment; or
- physical abuse or harassment
- Intentionally or recklessly interfering with normal CCC or CCC-sponsored programs, classes, workshops, or activities, including but not limited to:
- studio activities;
- displayed or stored artwork;
- administrative functions;
- board meetings; or
- fire, police, or emergency services.
- Intentionally, recklessly, or negligently removing, stealing, altering, tampering with, damaging, or destroying any property belonging to, used by, or leased to the CCC (including, but not limited to the facility at the Nadine Baum Studios and/or the Wheel Mobile), CCC Staff, CCC Volunteers, other students, studio members, or the property of any other person or entity located at the CCC Facility in the Nadine Baum Studios and/or the Wheel Mobile.
- Refusing or failing to comply with the reasonable directions of CCC Staff, Volunteers, Board Members, or interns acting in performance of their duties. This includes ignoring, disrupting, verbally threatening, abusing or harassing any of the above in the performance of his or her duties.
- Intentionally and substantially interfering with the freedom of expression of any member of the CCC Community on CCC premises or at CCC-sponsored activities.
- Intentionally furnishing false information to any CCC Staff and/or to the CCC.
- Intentionally initiating, or causing to be initiated, any false report, warning or threat at CCC sponsored activities
- Unauthorized use, possession, or distribution of alcohol on CCC premises. Please contact the Executive Director with questions concerning the CCC alcohol policy for adult classes and private parties.
- The illegal use or possession, of any prescription drug, illegal drug or drug-related materials on CCC premises.
- Unauthorized distribution, or possession for purposes of distribution, of any controlled substance, illegal drug, or paraphernalia.
- Engaging in disorderly conduct, public intoxication or lewd, indecent or obscene behavior on the CCC premises or at a CCC-sponsored activity regardless of location.
- Unauthorized use, possession or storage of any weapon on the CCC premises or at CCC sponsored activities.
- Any behavior that disrupts or causes disruption of CCC computer services; damages, alters, or destroys CCC data or records; or adversely affects CCC computer software, programs, systems or networks. This includes the intentional introduction of any computer contaminant into the CCC’s computer system.
- The use of CCC data, computer systems, or networks to devise or execute any scheme to defraud, deceive, extort, or wrongfully obtain money, property or data.
- Unauthorized use of CCC computer files or unauthorized access to CCC restricted network systems or computer files
- Entering the Kiln room without the express permission of CCC Staff
- Handling any dry mixing materials in the glaze room or Kiln room.
- Engaging in any of the above conduct may result in dismissal from CCC programs, classes, activities, removal from CCC facilities (including the Wheel Mobile) and/or being barred from participation in future CCC programs, classes, and/or activities. In no event will dismissal from a program, class, or activity entitle the offender to a refund of tuition or fees.
- MISBEHAVIOR CATEGORIES and CCC STAFF REPORTING CRITERIA
- Minor misbehavior – minor misbehavior constitutes, but is not limited to, conduct that: interferes with another CCC Community Member’s work or concentration; verbally taunting another CCC Community Member; talking when CCC staff is providing instruction; yelling; running; horseplay; jostling other students; touching other students or their work or threatening to do so; failure to follow CCC staff instructions; handling materials or equipment in an unsafe manner; or leaving/entering an area of the CCC premises after being advised otherwise. Behavior is considered minor when the participant corrects said behavior when directed to do so by CCC Staff.
- Moderate Misbehavior – moderate misbehavior is any conduct described in minor misbehavior (or a combination of behaviors) that occurs after the participant has been verbally warned, and:
- If a student: the conduct continues or reoccurs during the student’s enrollment in that class, workshop or program; or
- if a studio member: the conduct continues or is repeated within a 30-day period.
- Disruptive Misbehavior – Disruptive misbehavior includes any behavior or conduct that:
- substantially disrupts the performance of a class, workshop, program, or administrative function;
- threatens or alarms anyone in the CCC Community;
- intentionally or recklessly causes injury to anyone in the CCC community; or
- results in minor or moderate (< $100) damage to Nadine Baume Studios, the CCC Premises, or the personal property or artwork of any member of the CCC community.
- Severe Misbehavior or Dangerous Conduct – “Severe Misbehavior” consists of: any policy violations involving alcohol or controlled substances; the possession, use or threatened use of firearms or deadly weapons; theft; intentional vandalism; or, any “Disruptive Misbehavior” (see subsection 3) that continues unabated. “Dangerous conduct” is behavior that constitutes a physical threat or creates a substantial risk of death or bodily injury to any CCC Community member, to any third party on CCC premises, or to any person attending or present at any CCC-sponsored function. Dangerous Conduct also includes any behavior or threat of behavior that constitutes a substantial risk of serious damage (> $100) to the CCC premises, or results in serious damage (> $100) to the CCC premises.
- REPORTING PROTOCALS AND PRESCRIBED ACTIONS
- Minor Misbehavior: CCC Staff Members who witness or learn of minor misbehavior are required to verbally instruct the participant in question to correct that behavior. There is no need to report the incident if the participant’s behavior is corrected.
- Moderate Misbehavior: CCC Staff Members who witness or learn of moderate misbehavior should inform the Education Program Manager and file a written incident report before the end of the business day. The witnessing CCC Staff Member is required to instruct the participant to cease the behavior immediately. Within 48 hours the Education Program Manager will contact adult participants directly and issue a warning. Incidents involving participants under the age of 18 will be reported directly to parents/legal guardians as soon as practicable (preferably within 24 hours). The Witnessing CCC Staff Member must complete a written report naming the participants and describing the behavior before the end of the business day. All reports must be submitted to the Education Program Manager upon completion.
- Disruptive Behavior – Participants 18-years-old or older: conduct constituting disruptive behavior will be reported immediately to the Education Program Manager. The Education Program Manager will ask adult participants to leave the premises. The witnessing CCC Staff Member will provide a complete an incident report before the end of the business day. Disruptive behavior will result in immediate dismissal from the class/program/camp without a refund.
- Dismissal Notice: The Education Program Manager will provide verbal (a phone call is fine, and preferable if there is any indication that communication by phone is prudent for safety reasons) and written notice (email is fine) to the participant describing the behavior in question and inform the participant that he or she has been dismissed from the program and should not return. The notice should clearly state that the participant is not permitted to return to the CCC premises during the remainder of the class or program, and that arrangements should be made for a third-party to retrieve any property belonging to the participant. Dismissal requires the participant to get written permission from the Education Program Manager before enrolling and/or participating in any future classes, workshops, or programs.
- Disruptive Behavior – Participants under 18-years-old: conduct constituting disruptive behavior should be reported immediately to the Education Program Manager. The student or studio member will be separated to avoid disrupting the rest of the CCC community and the student’s parent/legal guardian will be contacted immediately and informed that their child should be picked up for the day. The witnessing CCC Staff member will provide a written incident report before the end of the business day:
- Dismissal Notice: The Education Program Manager will provide verbal (a phone call is fine, and preferable if there is any indication that communication by phone is prudent for safety reasons) and written notice (email is fine) to the participant’s parents/legal guardians describing the behavior in question and and inform the participant’s parents/legal guardians that their child has been dismissed from the program and will not be permitted to return. The notice should clearly state that the participant is not permitted to return to the CCC premises during the remainder of the class or program, and that arrangements should be made for a third-party to retrieve any property belonging to the participant. Dismissal requires the participant to get written permission from the Education Program Manager before enrolling and/or participating in any future classes, workshops, or programs.
- Severe Misbehavior or Dangerous Conduct: After witnessing or learning of Severe Misbehavior or Dangerous Conduct, CCC Staff should ask the participant to immediately leave the classroom/studio space and accompany the participant to the administrative office. The Education Program Manager should be informed immediately. If CCC Staff believes it prudent, the authorities may be called. If the participant is a child, his or her parents/legal guardian will be notified and informed that the child should be picked up for the day. If the participant is an adult, the participant will be asked to leave the premises. If the participant refuses the request, CCC Staff should call the authorities. Witnessing CCC Staff will file an incident report before the end of the business day and deliver that report to the Executive Director. Severe Misbehavior or Dangerous Conduct will result in expulsion from programs, classes, and activities and result in a permanent ban from future programs, classes and activities. In the case of severe misbehavior or dangerous conduct, the following notification requirements shall be followed:
- Dismissal and Ban Notice: Within 12 hours form the time the incident occurred, the Program Education Manager will contact the participant (or his or her parents/legal guardians) by phone and explain the participant has been dismissed from the class or program. The notice should clearly state the activity for which the participant has been banned, that the participant is not permitted to return to the CCC premises, and that arrangements should be made for a third-party to retrieve any property belonging to the participant. In addition, the Notice shall clearly state that the participant is not permitted to return to the CCC premises. Finally, a copy of the Final Determination Notice will mailed to the participant’s permanent address by certified mail.
- Record Keeping: CCC Staff will keep a permanent record of all Incident Reports, Dismissal Notices, and Dismissal and Ban Notices. The names of any dismissed or banned participants will be maintained and regularly cross-referenced against all new enrollments.

- Acknowledgement of Community Creative Center Code of Conduct Agreement
- Any behavior or activity that disrupts the classroom or safety of the students, or that affects the staff’s ability to provide services, is prohibited. Upon the first occurrence, the student will be removed from the classroom and parents/guardians will be informed. If the behavior continues, the student will be dismissed and no refund will be issued.
